The NSW Government has recently introduced the Local Government and Planning Legislation Amendment (Political Donations) Act 2008. This Act requires anyone making any submission on a planning matter (eg, to a development proposal, development control plan, or rezoning issue) being dealt with by Council, to disclose political donations (up to a certain value) to any local councillor or gifts to any local councillor or council employee within a 2 year timeframe before a submission is lodged.
Note; This Act comes into effect on 1 October 2008 and includes submissions made on the Bonnyrigg Living Communities Project Voluntary Planning Agreement as this closes on 8 October 2008.

DRAFT RATE REBATE POLICY
Reference No: 09/01215
Under Council’s Heritage Rate Rebate Council provides a 50% subsidy (up to a maximum of $3000) for rates payable by owners of heritage items listed under Schedule 4 of the Fairfield Local Environmental Plan 1994. This policy plays an important role in assisting with the maintenance costs of heritage items.
A draft Amendment to the policy has been adopted by Council at its meeting held on 20 October 2009 for public exhibition. The draft amendment introduces a process for withdrawing the rate rebate where it is considered that the item is not being adequately maintained.

Council is exhibiting for public comment a Proposed Amendment to the Policy for the use of Footpaths in Commercial Centres, Outdoor Dining (2004) – Canley Heights Town Centre.
This amendment to the policy for the use of Footpaths in Commercial Centres proposes to allow both fixed and temporary shade structures and other associated furniture for outdoor dining in the Canley Heights Town Centre.

Draft Site Specific Development Control Plan- Lalich Avenue, Bonnyrigg, Proposed Subdivision Layout
Council’s Services Committee at its meeting held on 8 September 2009 resolved to exhibit the Site Specific Development Control Plan for Lot 320 DP 263089, No 1 Wearne Road and Lot 1 DP 616457, 47 Brown Road, Bonnyrigg. The site specific DCP shows a proposed subdivision layout on existing residential zoned land, including the extension of Lalich Avenue from Coori Place to Brown Road. The subdivision will complete the road pattern planned for the area.

Fairfield City Wide Development Control Plan (DCP) 2006 - Ammendment No. 8

Council’s Outcomes Committee at its meeting held on 9 June 2009 resolved to exhibit amendments to Fairfield City Wide Development Control Plan (DCP) 2006. The amendments (known as “Amendment No.8”) are part of an annual review to rectify anomalies and clarify requirements, so that controls are better understood by the public and administered in a manner intended by Council. Bonnyrigg Living Communities Project

Why is the re-exhibition taking place?
The re-exhibition of the Voluntary Planning Agreement (VPA) for the above proposal is taking place primarily as a result of a proposed amendment to clause 17 of the VPA covering registration of the agreement on the title of the Bonnyrigg Estate Land. Exact details in relation to the proposed amendment can be viewed with the public exhibition material.
The VPA incorporates the following documents:
- Draft Voluntary Planning Agreement (legal agreement/ contract);
- Draft Infrastructure Services and Delivery Plan (ISDP);
- Plain English Explanatory Note; and
- Infrastructure Services and Delivery Plan Maps
Why has the plan been prepared?
This agreement proposes to set aside the developer’s requirement to pay Development Contributions, subject to the construction of infrastructure and provision of services outlined in the Draft ISDP. This plan provides, in broad terms, for:
X the construction of the road network on the estate;
X provision of parks and open space and their embellishment;
X stormwater management works that manage the quantity and improve the quality of stormwater;
X construction of a multi-purpose Community Building;
X dedication of all land for the above works; and
X monetary contributions to the library and to youth and children’s services .

Under delegation of the Director-General of the Department of Planning, Fairfield City Council (the Council) will carry out all the functions of the Director-General under Part 3A of the Environmental Planning and Assessment Act 1979 (the Act) including assessment of the project.
Description of proposal: The Proponent is seeking approval of a Concept Plan and Project Application (covering Stage 1) for redevelopment and renewal of the Dept of Housing Estate in Bonnyrigg (excluding a number of privately owned properties existing within the Estate) involving:
- Demolition of existing dwellings in stages.
- Staged construction of approximately 2,330 dwellings in 18 stages over 13 years, including lifted apartments, attached homes (in 2, 3, 4, 6 and 8-plex configurations) and detached homes.

RE - EXHIBITION OF DRAFT VOLUNTARY PLANNING AGREEMENT
- Staged construction of a multi-purpose centre comprising community, retail and commercial uses.
- Retention and upgrade of existing roads, construction of new roads and provision of a pedestrian and bicycle movement network.
- Reconfiguration and upgrade of existing public open space, stormwater infrastructure works.

The Stage 1 Project Application comprises:
- Construction of new dwellings, comprising a mixture of one and two storey attached and detached homes and subdivision into torrens title lots.
- Retention and upgrade of existing roads, realignment and extension of Bunker Parade and construction of new roads.
- Reconfiguration of an existing park (part of which is currently known as Tarlington Reserve) and provision of public infrastructure.
- Stormwater infrastructure works including construction of a stormwater detention facility in a proposed new park.
- Retention and extension of existing services infrastructure.
Application of Part 3A
The Minister for Planning has formed the opinion pursuant to clause 6 of State Environmental Planning Policy (Major Projects) 2005 (MP SEPP) that the project is for the purpose of development described in Schedule 1 of the (MP SEPP) (Clause 13, Group 5 Residential, Commercial or Retail Projects). The proposal is thus declared to be a project to which Part 3A of the Act applies.
