It is illegal, as well as a nuisance, to light fires and burn off materials in your backyard. 

Council Officers will respond to complaints about backyard burning and will take action to ensure fires are extinguished.

A fine may be issued.

Backyard burning and unauthorised incineration are prohibited at all times in all Council areas in the Sydney, Wollongong and Newcastle regions, and in other NSW Council areas listed in the Protection of the Environment Operations (Clean Air) Regulation 2010.

A number of ways are suggested in dealing with backyard burning complaints:

  • Talk to your neighbour. 
  • Contact a Community Justice Centre that specialises in settling differences between neighbours
  • Contact Council on 9725 0222. 

Anyone in Fairfield City who wants waste removed can contact Council's Waste Services Department on 9725 0222.

Note: It is not always possible for Council Officers to respond to backyard burning complaints because they tend to happen either early or late on Saturdays, Sundays and Public Holidays. You should still contact Council and report backyard burning.
