Draft Local Infrastructure Contributions Plan 2023 (Amendment No.1)

At its Outcomes Committee meeting held on 3 December 2024, Council resolved to publicly exhibit Draft Local Infrastructure Contributions Plan 2023 (Amendment No.1). The public exhibition is in accordance with the Environmental Planning & Assessment Act 1979 and clause 213 of the Environmental Planning & Assessment Regulation 2021. Draft Local Infrastructure Contributions Plan 2023 (Amendment No.1)

The draft Local Infrastructure Contributions Plan 2023 (Amendment No.1) includes the following changes which are identified in red in the draft document:

  • Includes gross floor area (GFA) for secondary dwellings to accurately determine residential dwelling size (0-1 bedroom, 2 bedroom and 3+ bedroom)
  • Includes definition of “bedroom” in body of the Plan (currently included in the Dictionary in Appendix 1)
  • Includes reference to “secondary dwelling” in the definition of “bedroom”
  • Updates to administrative chapters and references throughout the Plan.

Once approved, the draft Local Infrastructure Contribution Plan 2023 (Amendment No.1) will replace the current Local Infrastructure Contribution Plan 2023 which came into force on 26 February 2024.

Exhibition closed - 1 Cutler Road, Lansvale – Rezoning from R2 Low Density Residential to E4 General Industrial

EXHIBITION PERIOD CLOSED

On 11 February 2025, Council resolved to submit the Draft Planning Proposal to the Department of Planning, Housing and Infrastructure (the Department). Council received Gateway Determination (approval to proceed subject to conditions) from the Department on 31 March 2025.

The proposal seeks to amend the planning controls for 1 Cutler Road, Lansvale under the Fairfield Local Environmental Plan 2013 as follows.

  • Rezoning land from R2 Low Density Residential to E4 General Industrial; 
  • Amending the maximum height of building control from 9m to no maximum building height, (consistent with the E4 zone and other industrial lands in Fairfield Local Government Area (LGA));
  • Amending the floor space ratio control from 0.45:1 to no floor space ratio, (consistent with the E4 zone and other industrial lands in Fairfield LGA);
  • Amending minimum lot size from 450m2 to no minimum lot size, (consistent with the E4 zone and other industrial lands in Fairfield LGA);
  • Amending the lot size for dual occupancy from 900m2 to remove reference to the site; and,
  • Allowing development, permitted with development consent, for consulting rooms, information and education facilities, medical centres or specialised retail premises, (consistent with the E4 zone and other industrial land in Fairfield LGA).

The public exhibition was from Monday 7 April 2025 to Tuesday 6 May 2025. During this exhibition period, residents were encouraged to submit their comments on the proposal.

Have your say – Canley Heights and Canley Vale Special Entertainment Precincts

Council invites you to have your say on the draft Planning Proposal (Proposal) for the Canley Heights and Canley Vale Special Entertainment Precincts (SEPs).

What are SEPs?

 The SEPs are part of Council’s and the State government initiative to revive the night-time economy while also aiming to generate further local tourism.  It is the first step in activating the City’s night-time economy by utilising planning systems to provide greater flexibility around late-night trading in SEP areas. 

The Canley Heights and Canley Vale SEPs are proposing to:

  • Allow an extended 1-hour trading,
  • An additional 2-hours on nights where live-entertainment is provided, without the need of an approval,
  • Late trading permitted to no later than 4am, and
  • Extended trading to approved outdoor dining until 11pm.

Planning Proposal

On 13 May 2025, Council resolved to submit the draft Proposal to the NSW Department of Planning, Housing and Infrastructure (DPHI) to establish SEP areas in the Canley Heights and Canley Vale town centres.

A Gateway Determination has been now issued to proceed with the Proposal, with the condition for Council to publicly exhibit the proposal and consult with relevant stakeholders. 

The Proposal seeks to amend the Fairfield Local Environmental Plan 2013 to include areas within Canley Heights and Canley Vale to be identified as Special Entertainment Precincts.

The identified SEPs will activate the proposed extended trading hours through the supporting draft Precinct Management Plan and draft development controls for businesses to adhere to when dealing with sound from entertainment.

The public exhibition period runs from [30 June 2025] to [25 July 2025]. During this exhibition period, the public are encouraged to submit the comments on the Proposal.
